Required by NYS law and Nassau County code
All residential swimming pools in Nassau County — in-ground and above-ground — must have a code-compliant barrier (fence). Pools without proper barriers are subject to fines and insurance issues. A pool fence permit is required separate from the pool permit itself.
Nassau County Pool Fence Requirements
Minimum height: 48 inches (4 feet)
Measured from grade on the outside (non-pool side) of the fence. Inside grade measurement is not acceptable.
Maximum bar/picket spacing: 4 inches
Vertical spacing between any two fence members cannot exceed 4 inches. This prevents children from squeezing through.
No handholds or footholds below 45 inches
Horizontal rails, cross members, or decorative elements that could help a child climb must not be present within the bottom 45 inches of the fence.
Self-closing gate required
All gates must close and latch automatically when released from any open position. Gate must swing away from the pool area.
Self-latching gate with pool-side latch position
Gate latch must be located on the pool side of the gate at a height of at least 54 inches from grade, or otherwise inaccessible to children.
No direct house-to-pool access without gate
If the house wall forms part of the pool barrier, any door accessing the pool area must be equipped with an approved alarm or self-closing/latching mechanism.
Permit required before installation
You must have a pool barrier permit approved before the fence goes in. Retroactive permitting is possible but more difficult.
What the Inspector Checks
Nassau County pool fence inspections are thorough. The inspector will typically check:
- Fence height at multiple points around the perimeter
- Picket spacing with a 4-inch ball test
- Absence of climbable elements below 45 inches
- Gate self-closing mechanism — tested from multiple positions
- Gate self-latching — latch position and height verified
- Gate swing direction (must swing away from pool)
- Continuity of the barrier — no gaps over 4 inches anywhere
- Any house wall used as part of the barrier — door alarm or hardware

How long does pool fence installation take?
Most residential pool fences (140 to 200 linear feet) install in one day. The gate typically takes an additional 1 to 2 hours. Permits must be pulled before work begins, which typically takes 1 to 3 business days.
